Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WeLose application and related services (collectively, the "Service") operated by G & M Enterprises LLC ("WeLose," "Company," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Medical Disclaimer

WeLose is a personal tracking tool only. It is not a medical device and does not provide medical advice, diagnosis, or treatment recommendations. Nothing in the Service should be construed as medical advice.

Always consult a qualified healthcare provider before starting, changing, or stopping any medication or weight loss program, including GLP-1 medications. Do not use information from the Service as a substitute for professional medical advice.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable law or regulations
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit any harmful, offensive, or disruptive content

5. Subscriptions

Certain features of the Service are available through a paid WeLose Pro subscription. Subscription terms, pricing, billing, and cancellation are governed by our Subscription Terms of Service and Apple's App Store terms.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by G & M Enterprises LLC and are protected by applicable intellectual property laws.

Your personal data (weight entries, dose logs, notes) remains yours. We claim no ownership over the content you enter into the app.

7. User Data and iCloud

Your app data is stored locally on your device. WeLose Pro subscribers may optionally sync data via Apple's iCloud. By using iCloud sync, you also agree to Apple's iCloud Terms of Service. We do not access or control your iCloud data directly.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, G & M ENTERPRISES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless G & M Enterprises LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
